These Terms of Use (“Terms,” “Terms of Use,” or “Agreement”) are entered into by and between You Transformed LLC, doing business as Transform Pelvic Health (“Company,” “TPH,” “we,” “our,” or “us”), and you (“Client,” “user,” “you,” or “your”).

These Terms govern your access to and use of transformpelvichealth.com and any related content, products, programs, services, features, functionality, and communications offered on or through the site (collectively, the “Website” or “Services”), whether as a guest or a registered user.

By accessing or using the Website or by clicking to accept or agree to the Terms of Use when that option is presented, you accept and agree to be bound by these Terms, our Privacy Policy (incorporated herein by reference), and any other terms and policies referenced herein. No doctor-patient or therapist-client relationship is created by your use of the Website or Services. Always consult a licensed medical professional regarding your health.

3. HIPAA Disclaimer

We are not a covered entity under the Health Insurance Portability and Accountability Act (“HIPAA”). While we safeguard your information, any health information you share is not considered Protected Health Information (PHI) under HIPAA, and we do not provide HIPAA-compliant services.

4. User Conduct

You agree not to:

  • Share your account credentials; memberships are for individual use only.

  • Copy, reproduce, or distribute our content without prior written permission.

  • Post or share vulgar, obscene, defamatory, or hateful content.

  • Harass, threaten, or impersonate others.

  • Engage in hacking, malware distribution, reverse engineering, scraping, or unauthorized access.

  • Upload or share viruses or malicious code.

We reserve the right to suspend or terminate your access for any violation.

7. Purchases and Payment

By purchasing a Program, Product, or Service, you authorize us to charge your chosen payment method. Payments are due immediately unless otherwise stated.

If payment is not received, we reserve the right to suspend or terminate your access. All sales are final except as outlined in the Refund Policy.

We may use third-party payment processors and are not responsible for their policies or actions. Please review their terms and privacy policies before completing a purchase.

8. Refund Policy

To qualify for a refund, you must:

  1. Complete all modules and actions in the Program;

  2. Submit your baseline questionnaire prior to starting;

  3. Actively participate in coaching interaction (ask questions/stay in contact with coach); and

  4. Provide proof of participation if requested (screenshots, logs, etc.).

Requests must be submitted in writing to [email protected] within 90 days of purchase.

Refunds are not available for:

  • One-on-one sessions, consultations, retreats, workshops, or live events;

  • Digital products, memberships, or community subscriptions;

  • Purchases outside the 90-day window.

Refund decisions are made at our sole discretion. Except as outlined, all sales are final and non-refundable.

9. Termination

We may terminate your access to the Website or Services at any time, without notice, for any violation of these Terms.

10. Disclaimer of Warranties

All Programs, Products, Services, and Program Materials are provided “as is” without warranties of any kind, express or implied. We do not guarantee specific outcomes or that the Website or Services will be error-free or uninterrupted.

11. Limitation of Liability

To the fullest extent permitted by law, You Transformed LLC, its officers, employees, and affiliates shall not be liable for any damages, including incidental or consequential damages, arising from your use of our Website or Services.

Our total liability for any claim shall not exceed the amount you paid to us for the Program, Product, or Service giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless You Transformed LLC and its affiliates from any claims, losses, damages, or expenses, including attorneys’ fees, arising out of your use of the Website or Services or violation of these Terms.

13. Dispute Resolution; Arbitration; Class Action Waiver

Any dispute arising from these Terms shall be resolved exclusively through binding arbitration in Dallas, Texas, in accordance with the American Arbitration Association rules.

You waive any right to participate in a class action or collective proceeding.

You must initiate arbitration within one (1) year of the dispute, or the claim is waived.

14. DMCA and Takedown Policy

If you believe any content on the Website infringes your copyright, please send a notice with your contact information, a description of the work, and proof of ownership to [email protected].

15. Privacy and Cookies
